October, 2008 Deer Creek Ranch Board Of
Directors Communication
Feedback from the 10/01/08 Deer Creek Ranch annual HOA
meeting indicated that there was a desire for more and
periodic communications from the Board regarding past
and present activities. Towards that end, this
communication should serve as an initial attempt to
answer that need now and on a periodic basis going
forward.
2008
year to date saw a number of improvements within the
boundaries of the HOA:
-
Mulching at all of
the common areas within the boundaries of the HOA.
-
Weed
herbicide and fertilization of the common areas on
Anderson Mill Road.
-
Significant
improvements to the Quiet Moon Amenity Center and
pool area.
-
Some additional
new furniture
-
New barbecue
grills.
-
Painting, power
washing and staining throughout.
-
Playscape shade
cover.
-
Shade cover
installation at the Zappa Swim Center, power
washing & cleaning throughout and several new
furniture pieces.
-
Additional HOA area
security patrols provided by the Travis County
Sheriff’s Department.
-
“No Parking” signs on
Painter Pass and “5 Minute Mail Pick-up parking
only” signs at the Zeppelin Mailboxes.
-
Wi-Fi capabilities at
both swimming centers.
-
Enhanced access key
security systems at both swim Centers.
The
Board of Directors met for their quarterly meeting on
Wednesday, October 8, 2008, and the following was
accomplished;

The
following were the results of the election;
-
John Bittner was
appointed President of the DCR HOA Board of
Directors.
-
Gary Wright was
appointed Vice President of the DCR HOA Board of
Directors.
-
Joan Surko was appointed Secretary of the DCR
HOA Board of Directors.
-
2009
Landscape quotations were reviewed for mowing,
trimming, etc... As of this meeting we had only one
additional quote available for review in addition to
the quotation from Redd’s Landscaping. It was
decided to wait on receipt of the 3rd
quotation before making a decision on the 2009
landscaping contract award.
-
Preliminary work on the 2009 annual budget was
started. Each line item was reviewed on an YTD
expenditure basis and a number of line item
expenditures were forecasted for 2009. Considerable
work yet remains on the budget and we hope to have
it completed in mid/late December.
-
Three significant expenditures are planned for 2009.
They are as follows;
-
To construct
solar lighted mailbox kiosks/covers at all
mailbox locations within the entire HOA area.
Currently there are 13 mailbox locations, two of
which have a kiosk/cover (but not lighted) built
around/over the mailboxes. We have started the
quotation process and look to have that
completed in mid/early December. The BOD will
make a decision once the quotation process is
completed in concert with the 2009 budget and
any resident input.
-
Landscaping
improvements throughout the HOA area. Trees,
shrubs, ground cover to be replaced as
necessary. Additionally, irrigation and
landscaping plans are in the works as well as
estimates for the center median on Anderson Mill
road, between Zappa Drive and Lime Creek Road.
-
Decking safety improvements/coatings at both the
Zappa Swim Center and the Quiet Moon Amenity
Center.
-
Board conversation ensued about establishing a
resident advisory committee. A decision was tabled
pending further definition regarding a
website/newsletter/communications plan for the HOA.
It was also felt that overall, each member of the
Board of Directors is easily accessible either by
e-mail or by phone. For now, Resident input is
encouraged via this direct method of communications
vs. through the establishment of any intermediate
advisory council.

Information about Parking on the Street in Deer Creek Ranch

We are the attorneys for the
Deer Creek Ranch Homeowners Association, Inc. and have been
requested by the Board of Directors to address what we
understand is an ongoing question of the meaning and intent
of restrictions on on-street parking found in the Deer Creek
Ranch Master Declaration of Covenants, Conditions and
Restrictions.
In general, the terms,
conditions and restrictions found in the Declaration provide
the terms of a “contract” between the original developer of
the subdivision and all persons who subsequently bought
properties within the subdivision. The Declaration was
created and filed in the appropriate County records before
any lots or improved properties were sold. All subsequent
buyers bought their properties “subject to” the pre-existing
provisions of the Declaration and by doing so each purchaser
agrees with the developer and every other purchaser to be
bound by those provisions.
What must be appreciated is
that no one other than the developer and the subsequent
purchasers are bound by those restrictions. They are not
like a city ordinance which applies to everyone within the
city limits whether they live there or not.
The parking restrictions
found in the Declaration apply only to those who own
property within the subdivision subject to the terms of the
Declaration. They do not apply to guests or delivery persons
or any other person. The streets in Deer Creek Ranch are
public streets and while everyone, including guests or other
visitors, are subject to any applicable city parking
restrictions, those guests and visitors are not subject to
the provisions of the Declaration.
In summary, absent any
applicable municipal restrictions on street parking,
visitors and guests may park anywhere in the streets of Deer
Creek Ranch, even if residents are prohibited from parking
in those same locations by the terms of the Declaration.

| VEHICLE ALARMS: Recently an
incident occurred in the community where an automobile alarm
went off and continued to sound for an excessive period of time.
The owner of the vehicle was out of town and could not be
notified. The Sheriff’s Department was contacted. Unfortunately
the Sheriff was unable to disarm the alarm.
If a situation like this occurs residents are
asked to contact Plateau Property Management (after hours number
1-888-728-2215) or a resident board member (info
on web site). A towing company will called to remove
the vehicle. Any legal fees or costs associated with the removal
will be the responsibility of the vehicle owner. |
Help Please Neighbors!
Please keep your eyes open for anyone
illegally dumping trash in the dumpster at the Quiet Moon Pool and
Amenity Center. Someone is using our dumpster to dump their trash and we
don't have room for the trash from the pool and Amenity Center. This is
costing the HOA hundreds of dollars for the extra pickups by the trash
collectors - and we can't keep up. Please call Plateau at (512)441-1041
with a license number if you see someone. |
